Q: Overview
Effective May 1st, 2024
Your CENTERFORCE® product is covered by the Limited Warranty explained below that gives you specific legal rights. Your warrantor for these parts is Midway Industries, Inc., 2266 Crosswind Dr., Prescott, AZ ("Midway"). This limited warranty is the only warranty Midway makes in connection with your purchase.
Q: What Is Covered?
Subject to the terms, exclusions, and limitations herein Midway warrants to the initial retail purchaser ("purchaser") only that the Midway supplied product shall be free of defects existing in material or workmanship for 12 Months as measured from the date of initial retail purchase. "Defect" means a failure in Midway's workmanship or materials selected to conform a product to Midway's intended design, which failure exists at the time the product is delivered. No warranty is made as to further performance of your part or vehicle. The term of limited warranty for products purchased other than through Midway authorized resellers is reduced to ninety days from the initial retail purchase date. This Limited warranty is not transferable. Retail Customer must be able to provide copy of purchase receipt or have copy of completed warranty registration on file with Midway.
Q: What Is Not Covered
Your Limited Warranty does not cover damage or claims other than with respect to defined defects nor to any component, vehicle, facility, or property other than the product sold by Midway. Your Limited Warranty does not cover any product Midway determines to have been damaged by or subjected to:
• Installation, application, alteration, combination or use not in accordance with Midway instructions & warnings, OEM installation and maintenance instructions, or accepted ASE guidelines (including slipping due to excessive torque from customer modified engines or racing).
• Damage to or in any part attributable to vehicle systems or components (including electronic stability control) not supplied by Midway.
• Normal wear and tear/product deterioration or loss of performance. This Limited Warranty is not a promise of future performance of your Midway component or your vehicle.
• Abuse, alteration or use in an incorrect application (including slipping due to excessive torque or racing)
• Accidents, theft, vandalism or other negligent or intentional damage.
• In consideration of the purchase price paid, neither Midway nor any independent reseller are responsible for any loss of use or time, rental costs, or for any incidental, consequential, punitive, or other damages (whether arising in tort, contract or otherwise) you may have or incur in connection with your vehicle, or your Midway product. TO THE EXTENT PERMITTED BY LAW ALL OTHER EXPRESS OR IMPLIED WARRANTIES ARE HEREBY DISCLAIMED & EXCLUDED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Q: Remedy Limited to Repair/Replacement/Limited Time for Filing Warranty Claims
The exclusive remedy under this Limited Warranty shall, upon Midway's inspection and option, be either repair or replacement with CENTERFORCE® parts, which shall carry the remaining limited warranty term of the originally purchased part. Written notice of any claim for breach/damages related to this Limited Warranty must be provided Midway within 20 days of customer's first notice or concern with a defect and in all instances within 90 days of the date your Limited Warranty expires (i.e. not later than twelve months and 90 days from initial retail sale ) www.centerforce.com/warranty.Customers requesting warranty consideration should then contact Midway customer service (ph. 928/771-8422) to obtain a Returned Merchandise Authorization (RMA) number. All removal, shipping and installation costs are the customer’s responsibility. In the event Midway is unable to repair or replace a part warranted hereunder, you agree the backup remedy and any claim of whatsoever type related to economic loss from the product shall be limited to the initial purchase price of the product, plus tax and shipping, if any. No employee of Midway, authorized reseller, installer or third person can alter or waive the terms of this Limited Warranty.
Q: Your Rights Under State Law/Dispute Resolution By Arbitration/Venue/Waiver of Jury Trial
This Limited Warranty gives you specific rights. You may also have other rights that vary from state to state. For example, while all implied warranties are disclaimed herein, any implied warranty required by law is limited to the duration and other enforceable terms of the express Limited Warranty described above. Some states do not allow limitations of how long an implied warranty lasts and/or do not allow the exclusion or limitation of incidental or consequential damages, so the limitations and exclusions herein may not apply to you.
Q: Dispute Resolution By Arbitration/Venue/Waiver of Jury Trial
For separate, valuable consideration received; all claims arising from or related to purchase or use of Midway supplied components shall be maintained as a separate action by each customer with exclusive jurisdiction, and venue in Yavapai County, Arizona and determination applying Arizona state law (without reference to treaties or conflict of law provisions) through binding arbitration before a neutral selected by Customer from the JAMS® panel closest to Prescott, Arizona. To the extent permitted by law, each party shall bear its own costs and fees. By submitting a claim you acknowledge acceptance of these Limited Warranty terms.
